KÄSSÄ KIRPPU MYI - TERMS OF USE

  1. A person registers as a seller by purchasing a sales service product.
  2. In the Kässä Kirppu myy sales model, the seller can sell products belonging to Kässä Kirppu's product categories. An up-to-date list of products accepted for sale can be found here . Kässe Kirppu reserves the right to decide on the products and product units to be sold. Kässe Kirppu can combine products into wholes sold as packages, for example.
  3. The seller undertakes to deliver the goods for sale in accordance with the service provider's instructions within 14 days after the delivery instructions have been delivered. The customer can mail the shipment free of charge using the shipping code he received from the service provider.
  4. The service provider is entitled to keep the price paid for the service if the seller does not deliver the products to the post office within 14 days.
  5. The service provider receives the goods sent by the seller and acknowledges the shipment as received. The goods must be intact, clean, odorless (mention if washed with perfumed detergent) and spotless in order to be listed for sale by Kässä Kirpu.
  6. The Service Provider has the right to reject the Sales Lot or its part if it does not meet the above-mentioned conditions. Rejected products are not delivered back to the user, but are delivered for recycling by the service provider.
  7. Kässe Kirppu inspects, photographs, enters product information and prices the products in accordance with the established uniform standards. Kässe Kirppu tries to take into account the manufacturer and condition of the products in the pricing phase as well as possible. The user cannot influence the images, information or prices of the products themselves, but accepts the product announcements made by Kässä Kirpu as such. When delivering a sales batch, it is good to inform if the product to be sold is in some way of special quality, e.g. material or manufacturer.
  8. The products are published for sale on the service provider's online service at the price set by Kässe Kirpu.
  9. Kässe Kirppu notifies the seller by e-mail when the products have been released for sale. At the same time, the sales schedule is delivered to the seller.
  10. The seller can monitor the sale of his products as instructed by Kässe Kirpu.
  11. The sales revenue will be realized and credited within 14 days after the seller's sales period has ended and the seller has announced his account number in accordance with Kässe Kirpu's instructions.
  12. The sales proceeds are divided between Kässä Kirpu and the seller according to the service price list valid at the time of the order. See the service price list . Possible additional costs are deducted from the seller's share.
  13. The sales period for products in the service is 13 weeks. The price of the product is reduced the first time after 5 weeks (-20%) and the second time after 9 weeks (-40%) from the time the product is published for sale. The price is reduced no more than 2 times.
  14. At the end of the sales period for the products, the seller can choose what to do with the unsold products from the options listed below:
    1. The products can be donated to charity
    2. Kässä Kirppu can redeem unsold products by paying the seller's share as a gift card to Kässä Kirppu's online store.
  15. The user's right to the products ends 14 days after the end of the sales period. The service provider's payment obligation for the products in question ends at the same moment when the user's right to the products ends and the products become the property of the service provider permanently.

SELL MYSELF TERMS OF USE

  1. A person registers as a seller by purchasing a sales service product.
  2. In the sell-it-yourself sales model, the seller can sell products belonging to Kässe Kirpu's product categories. An up-to-date list of products accepted for sale can be found here . Kässe Kirppu reserves the right to decide on the products and product units to be sold. Kässe Kirppu can combine products into wholes sold as packages, for example.
  3. The seller must himself describe, price and add the products to the Kässe Kirpu system according to the instructions given. In addition, sufficient product descriptions must be written for the products. The seller undertakes to perform the aforementioned tasks within 14 days of ordering the sales service.
  4. The seller undertakes to deliver the goods for sale in accordance with the service provider's instructions within 14 days after the delivery instructions have been delivered. The customer can post the shipment free of charge using the shipping code he received from the service provider.
  5. The service provider is entitled to keep the price paid for the service if the seller does not deliver the products to the post office within 14 days.
  6. The service provider receives the goods sent by the seller and acknowledges the shipment as received. The goods must be intact, clean, odorless (mention if washed with perfumed detergent) and spotless in order to be listed for sale by Kässä Kirpu.
  7. The Service Provider has the right to reject the Sales Lot or its part if it does not meet the above-mentioned conditions. Rejected products are not delivered back to the user, but are delivered for recycling by the service provider.
  8. Käs Kirppu checks the condition, numbers and descriptions of the received products.
  9. The products are published for sale on the service provider's online service.
  10. Kässe Kirppu notifies the seller by e-mail when the products have been released for sale. At the same time, the sales schedule is delivered to the seller.
  11. The seller can monitor the sale of his products as instructed by Kässe Kirpu.
  12. The sales revenue will be realized and credited within 14 days after the seller's sales period has ended and the seller has announced his account number in accordance with Kässe Kirpu's instructions.
  13. The sales proceeds are divided between Kässä Kirpu and the seller according to the service price list valid at the time of the order. See the service price list . Possible additional costs are deducted from the seller's share.

  16. The user's right to the products ends 14 days after the end of the sales period. The service provider's payment obligation for the products in question ends at the same moment when the user's right to the products ends and the products become the property of the service provider permanently.

General

Kässä Kirppu (kassakirppu.fi) is an online store maintained by Vol Seven Oy, where Vol Seven Oy (Y-ID 3175398-8) acts as a service provider. We reserve the right to change these terms and conditions without notice. In each order, the terms and conditions valid at the time of placing the order apply. The service provider is not responsible for direct or indirect damages caused to products or customers due to a force majeure situation, i.e. a force majeure. A force majeure is considered to be an unforeseen circumstance or a change in circumstances that is beyond the service provider's influence and that the service provider cannot reasonably overcome. The service provider is obliged to inform the customer of the force majeure that has occurred as soon as possible.

Here Kirpu's terms of use are for consumer customers. We comply with the provisions of the Consumer Protection Act (January 20, 1978/38). If the buyer is a company, other agreed purchase conditions or the Finnish Trade Act apply. The following terms of use apply to the service maintained by Vol Seven Oy (hereinafter the "Service Provider") at https://kassakirppu.fi (hereinafter the "online service"). These terms of use apply to sellers who have purchased a sales service product from Kässe Kirpu's online store or otherwise entered into a similar agreement with Kässe Kirpu. Seller means a person who orders a service or product from the online store.

A consumer is any natural person who makes a legal transaction, for example the registration or purchase of goods and services, which does not depend on his commercial or independent professional activity. A natural person can register as a seller.

Object of the contract

Use of Kassakirppu.fi online service.

Kassakirppu.fi offers sellers an online service that works on the internet, the purpose of which is to sell their used craft materials and supplies (hereinafter "Products") to buyers.

In addition, the service provider offers the buyer the opportunity to search for products from registered sellers or other third parties on the Kassakirppu.fi website and buy them from the service provider. The conditions related to purchases can be found under the headings Delivery conditions, Privacy statement, General terms of use and Return conditions.

The service provider offers the seller and the buyer the technical possibility to use the online service they maintain.

The features of the sales services can be found in the product descriptions and additional information of the online service. The characteristics of the products sold are mentioned in their product descriptions.

The service provider sells the products delivered to it by the seller.

The contract applies when the service provider sells products delivered by the seller.

By accepting the product for sale in the online service, the service provider undertakes to sell the product in accordance with the purchase conditions, provided that the product description given by the seller is accurate and that the sales conditions defined in these conditions are met.

Formation of the contract

A person can buy a sales service product at https://kassakirppu.fi . With the purchase of a sales service product, a contract is created between the service provider and the person (seller).

The seller must offer at least six (6) products for sale at once.

The service provider checks the products based on the information provided by the seller.

The seller is obliged to send the products to the service provider according to the instructions given by the service provider. The service provider is entitled to keep the price paid for the service if the seller does not deliver the products to the post office within 14 days.

When the service provider receives the products and publishes them for sale, a binding sales contract is created between the seller and the service provider and the products are transferred to the service provider's control. The service provider informs in writing (e.g. by e-mail) about the publication of the products for sale.

Electronic communication

All contract information, i.e. customer-related information, is sent to the seller by e-mail, partially automated. The seller must therefore ensure that the e-mail address given by the seller is correct and that receiving e-mail messages sent by the service is allowed. The seller must ensure that the spam filter does not block such emails.

Selling and selling products to the service provider

The seller can sell his products with the help of a service provider.

To use the service, the seller must deliver at least six (6) products for sale.

The service provider will notify you of the products' arrival at the warehouse. If the products do not match the product description, the service provider has the right to return the products to the seller or donate the products to charity. If the products are returned, the seller is responsible for the shipping and return costs.

Sale of products for the account of the Service Provider and reduction of the selling price

The products delivered to the service provider for sale are sold on behalf of the service provider.

If the buyer buys the product, the sales revenue is recorded in the seller portal for the seller to see. The sales revenue is realized and credited to the account no later than 30 days after the seller's sales period has ended. The seller must provide payment information in accordance with Kässe Kirpu's instructions.

Possible additional costs are deducted from the realized sales revenue. The remaining amount will be divided between Kässä Kirpu and the seller according to the service price list valid at the time of the order. See the service price list .

If the product has not been purchased by the time specified by the service provider, the price of the product will automatically decrease according to the schedule specified by the service provider. By delivering the products for sale, the seller gives the service provider permission to lower the price.

If the products have not been purchased from the service within the sales period specified by the service provider, the seller can choose one of the following options:

  • Donate Unsold products to charity. The products donated to charity are transferred to the service provider's ownership, and the service provider's obligation to pay the seller for the products in question ends.
  • Kässä Kirppu can redeem unsold products by paying the seller's share as a gift card to Kässä Kirppu's online store. The sellers themselves overpriced products are not redeemable.

The seller's right to the products ends fourteen (14) days after the end of the sales period. The service provider's payment obligation for the products in question ends at the same moment when the seller's right to the products ends and the products become the property of the service provider permanently.

The service provider has the right not to transfer the products donated to charity to the charity destination, if the transfer of the products causes costs or work for the service provider. In such a situation, the service provider can freely choose what to do with the products.

If the Service Provider receives a request to return the products to the seller, the service provider has the right to collect from the seller the shipping costs for returning the products to the seller as well as any other unpaid shipping costs that may have accrued.

If the product cannot be delivered back to the seller, the service provider will request new delivery information from the seller via e-mail. If the seller does not provide his address information to the service provider, the seller waives his right to compensation for the product and/or his right to decide on giving the products to charity.

Service availability

The service provider will do its best to ensure that the kassakirppu.fi service is available around the clock.

Occasional outages and service problems may occur for technical reasons independent of the service provider, depending on maintenance procedures and updates. The service provider has no responsibility for such situations.

Restrictions on Sale

In this Kirpu service, the seller can only sell products according to the product categories of the online store. The sale of the following products is prohibited in the service:

Weapons and weapon accessories, including commemorative, decommissioned and deactivated weapons, as well as cartridges, hand grenades, tasers and other similar products.

Pepper sprays, tear gas and other similar products.

Pornographic or otherwise harmful material for minors with an age limit of K18.

Drugs and equipment intended for their use, such as hookahs and pipes intended for smoking cannabis.

Tobacco products such as cigars, cigarettes, electronic cigarettes and other similar products.

Products that are in violation of Finnish criminal law, human rights, rights of third parties or other similar rights.

Easily breakable products, such as porcelain dishes and objects containing glass.

Content usage rights

The content of the online service is protected by copyright, and the rights are owned by the service provider producing the content, users or third parties. The user can use the contents in question only in accordance with these terms of use and the terms of the service.

By adding product information and product images to the service, the seller grants the service provider unlimited and transferable access to the content provided by the seller, such as

  • publish and store content produced by the seller on the server
  • edit, reproduce and translate content if necessary, for example in newsletters, blogs and social media channels used by the service provider and
  • if the seller removes content from the service, its right to use the content for new purposes ends. However, the service provider has the right to keep copies of the content for backup purposes. If the seller removes the content, the seller's rights to use the already published content remain unchanged.

Intellectual property rights and damages

The service provider checks the products offered for sale by the seller.

The service provider can publish content owned by the seller on the online service on behalf of the seller. The seller cannot publish content or information that violates third-party rights (especially copyrights, brand names, trademarks, design rights or other intangible rights) or violates applicable laws.

The service provider has the right to temporarily block or completely remove individual users or content if the User publishes illegal content or violates the terms or if there are concrete indications of repeated illegal publication attempts.

Before the service provider temporarily blocks or completely removes the user and/or certain content, the service provider takes into account the user's rights and possible negligence. The service provider informs the user in writing (e.g. by e-mail) of the reasons for temporarily blocking or deleting the user and/or the content.

If it is a temporary block, the service provider will restore the user's access to the online service without undue delay as soon as suspicions of a violation of the law or contractual terms have been dispelled.

The user is solely responsible for legal violations and their consequences, both towards the service provider and the offended party. The user is responsible for all claims for damages of the service provider caused by the negligence of a third party, related to the user's activities, resulting from the violation of intangible rights. The liability also covers legal costs arising from illegal or inappropriate use of the service provider's online services related to the user's actions.

Contract duration, changes and termination

The agreement regarding the use of the service is valid until further notice.

The user always has the option to delete his customer account by notifying the service provider's customer service by email.

Both parties have the right to terminate the contract immediately if the other party violates the terms of the contract in a significant way and does not remedy the breach despite notice.

The service provider has the right to change the terms of use. The service provider must inform the user of changes to the terms of use, and the user must accept the terms in order to continue using the service.

Applicable Law, Enforcement and Jurisdiction for the Service

Finnish law applies to the online service.

The provisions of the UN Convention on International Trade Agreements are not applicable to the online service.

Out-of-court dispute resolution

If the disagreement regarding the sales contract cannot be resolved through negotiations between the parties, the consumer can refer the matter to the Finnish Consumer Disputes Board (www.kuluttajariita.fi).

Before taking the case to the Consumer Disputes Board, the consumer must contact the magistrates' consumer advisory service (www.kuluttajaneuvonta.fi).

The European Commission maintains the Online Dispute Resolution Forum, or ODR Forum, which operates at http://ec.europa.eu/odr .
